To ensure your Living Will is both legally valid and enforceable it is advisable to take proper legal advice. You can draw up a Living Will without much formality or legal advice but the Mental Capacity Act Code of Practice states:
“Some people may...want to get legal advice. This will help them make sure that they express their decisions clearly and accurately. It will also make sure that people understand their advance decision in the future”. (Paragraph 9.15).
Homemade “ordinary” Wills (dealing with your money and property) are often called “Solicitor’s friends” because they create work for lawyers. The same can apply to Living Wills that are not professionally drafted.
